E-Discovery Laws

Currently the E-Discovery laws are still evolving as the field is so vast it may never be completed field. With the virtual millions of pages of scattered documents within any given corporation there are some basic rules to follow.

Know your data : Any document stored for any corporation should have both a purpose and a retention policy in place. Corporate policy should dictate where documents can be stored and for how long.

Retention : Data is identical to printed or hard copy papers when it comes to a discovery motion, hence should be under the same policies. Documents required for long term storage should be kept appropriately.

Document Destruction : As per the retention policy all document destruction should be done exactly how policy is written. Any variation of this can be cause for legal penalties and a sense of mistrust.

Non Central Storage : Think about the data that is walking around outside of controlled servers. Laptops, PDA devices, cell phones and of course even home PC's.

Document Collection : How fast and easy can you currently retrieve all documentation if ordered? Is the data you recover complete? Is there data you will find that should have been purged?
